J. N. “Ding” Darling Copyright Fee Schedule

All Copyrights to Jay N. “Ding” Darling’s cartoons are owned by the “Ding” Darling Wildlife Society, an organization that supports the Jay N. Darling National Refuge on Sanibel Island, Florida. These rights are administered by The University of Iowa under terms of an agreement between the two parties. The University of Iowa Libraries’ Special Collections Department reviews requests, determines appropriate fees, and invoices users. Those making requests are required to identify the image(s) they wish to use and to describe explicitly the use(s) they wish to make of them on the Application to Publish “Ding” Darling Editorial Cartoons.

The Society encourages use of J. N. “Ding” Darling’s editorial cartoons by teachers and students within the classroom without specific written permission.

Additionally, the Society may reduce or waive fees to encourage not-for-profit organizations whose goal is public education, particularly in questions involving conservation of natural resources.  Organizations that feel they may qualify for waiver or reduction should so state on the Application to Publish “Ding” Darling Editorial Cartoons.  Acknowledgement by use of a credit line is required in all cases.

The Society charges a fee, as determined by the schedule which follows, for each image used for commercial purposes (whether educational or non-educational). The Society also requires a credit line in association with the image or elsewhere in the publication, such as in footnotes, a bibliography or a list of illustrations in a book or periodical, or the credits of a video or film.  This credit line should read:  Reproduced courtesy of the “Ding” Darling Wildlife Society.

Payment of the agreed use fee constitutes permission by copyright holder to reproduce works that are copyrighted. Users must determine on their own if the use they intend to make of images invades rights to privacy, or other rights.

As owners of the materials to be reproduced, the Society gives no exclusive rights to any publisher or author, makes no warranties or representations, and assumes no responsibility whatsoever for any claims against those reproducing images or against the Society by an artist or photographer, his/her agent, estate or any other party in connection with the reproduction of Darling images in the collections of the University of Iowa Libraries. Additionally, those reproducing images agree to indemnify the Society, The University of Iowa, the State of Iowa and the State of Iowa Board of Regents, its officers, employees, and agents, and hold them harmless against any and all such claims, including copyright infringement claims, royalty or fee demands and/or actions, including attorney fees and all other costs thereof, arising as a result of their reproduction of images in the Darling collections of the University of Iowa Libraries

Individuals, companies, and organizations must submit a clear statement of (a) who they are and what they do; and (b) precisely which rights they wish to license. Provide this information by completing an Application to Publish “Ding” Darling Editorial Cartoons.

Payment:  Do not send us payment directly. The University Finance Office will invoice you according to your billing instructions.  If a purchase order is required for billing, please include the number of your purchase order with your application.  Our tax identification number is 42-6004813
